The COVID-19 coronavirus poses a threath we need to take seriously so we don't want to take any chances. Our webshop remains fully operational so we can send you everything you need, but we can't help you face to face for now. We'll be back in the flesh as soon as the risk drops to an acceptable level. Terms and conditions

1 - GENERAL CONDITIONS

ART 1 - APPLICATION

Our sales are subject to the Belgian jurisdiction and only the terms and conditions stated below are to be applied, except if specific conditions were mutually agreed upon. All other conditions presented to us are unvalid. By placing an order, the buyer agrees with our general and particular conditions.

ART 2 - OFFERS

Our offers are not binding and are subject to the limits of existing stock levels.

ART 3 - REPAIRS

Materials are taken back for checkup and repairs within the limits of warranty our supplier imposes. If no defect can be found, the customer will bear costs for administration and tests, with a minimum of 25.00 €.

ART 4 - INVOICING

Invoices regarding deliveries are made in Dendermonde, where they are also to be paid. All present or future taxes ar to be beared by the customer. All invoiced prices are valid only the day of invoicing. Prices are subject to changes, even without upfront notice.

ART 5 - LEAD DELIVERY TIME

Lead delivery times are merely an indication of general delays and cannot be enforced or guaranteed. Further delays cannot be used as a reason to cancel an order or to claim a compensation, financial or other.

ART 6 - TRANSPORT

Freight charges are always beared by the customer. Regardless of the way of shipment or place of delivery, good always travel at the risk of the customer as soon as they leave the warehouse, except in case the buyer can hold the transporter accountable. In case of damage or loss, the buyer must signal any visible damage to the driver that delivers the package, in case the transport is carried out over road.

ART 7 - COMPLAINTS

Complaints regarding our deliveries cannot be taken into account if they haven't reached us within 8 days following the delivery of the goods.

ART 8 - LATE PAYMENT

When opening a customer account, after explicit agreement from our side, the customer agrees to pay invoices no later than 30 days following the date of invoice. Invoices which haven't been paid before the due date will bear a 1.50% interest per expired month, with a minimum of 25.00 €. Also, an invoice which hasn't been paid within one month after the due date, will be subject to an increase of 20%, with a minimum of 50.00 €.

ART 9 - OWNERSHIP

Contrary to article 1583 of the civil code, all delivered goods remain the sole property of the seller untill the full amount due, including costs and interests have been paid. The buyer agrees to keep the goods at disposal untill the date of full payment. The buyer agrees to apply article 401 of the law on bankcruptcies, so that in case the buyer goes bankrupt, the seller preserves the right to apply the article so that the seller can claim back the goods, which are still his property. Untill all conditions mentioned above have been met, the seller cannot use the delivered goods as collateral or pass them on to a third party.

ART 10 - JURISDICTION

Only the courts of Dendermonde are competent to judge disputes which may arise between the parties involved.

2 - GENERAL SALES CONDITIONS REGARDING SALES THROUGH OUR WEBSITE

ART 11 - RIGHT OF WITHDRAWAL, SATISFIED OR REFUNDED

The customer enjoys a period of 14 calendar days to give back a product that does not meet his expectations. The products shall be sent back at the customer's expense and the original invoice will be sent along. A damaged product will not be refunded. If a prduct returns in damaged or incomplete state, it will not be refunded, not even partially, adn will remain at disposal of the customer in our warehouses. It will not be shipped a second time. Goods packed in a blister or in a sealed package can only be sent back if the customer did not break the seal. The time indications mentioned above start the day after the customer received the goods. The amount due will be refunded via bank transfer on the bank account the customer indicates. The withdrawal right does not apply to professionals.

ART 12 - WARRANTIES

All sold materials are covered by by the warranty provided by the manufacturer. Freight charges to send material back are to be covered by the customer. Every return of goods should be carried out by the local postal service or an agreed logistics handler. The customer assumes repsonsibilitie for proper packaging that prevents damage to the goods during transport. If the goods would be damaged during transport, the customer can only seek redemption at the logistics handler he chose. Shipping costs are carried by the customer. Attention, warranty does not apply to repairs that need to be carried out as a result of damage due to an external cause such as an accident, tension peaks, shocks, or any mis-use by the customer resulting in an improper installation, extensive wear, lack of protection to external factors, ... Warranty does not cover: replacement of consumables (brake pads, bulbs, oil, ...), abnormal or improper usage. The customer should stock to the instructions covered in the manual, malfunctions or damage caused by use of accessories, damage caused by the intervention of an third party repair, damage due to an external factor (accident, shock, lightning, tension peak, ...)

ART 13 – PRICE

Prices mentioned on our website are in euros and cover all taxes, and do not include shipping costs. If shipping costs apply, these will be indicated in function of the products chosen at the end of the order, where they will be added to the price of the goods the customer selected. If the price which is indicated on the website has been subject to changes (in either direction) between the moment of ordering and the moment of shipping, or if a mistake has been made during the input of prices on the website, Bike Design will let the customer know and ask for his permission to deliver the goods at the correct price.

ART 14 - AVAILABILITY

We process orders in function of the quantity available in the warehouse. If one of the products ordered would not be available, we will contact the customer by email within 15 days after the order has been placed, to inform you of the suspected delay.

ART 15 - TAX EXEMPTION

Tax exemption is not possible.

ART 16 – PROTECTION OF YOUR PERSONAL DETAILS AND DATA

Your data will be processed according to the law of December 8 1992, regarding the processing of personal data. Explicitly, this means that: Your data will only be collected and used to reply to your request for information; Your data will not be transmitted to third parties or used for commercial goals; You have the right to consult your personal details and to verify whether they are indeed correct. You can have us correct any mistakes you'd find. You may contact the website administrator in order to do so. We will commit to take any security measure needed to prevent third parties from misusing personal data you provide.
